PUC: Pennsylvania law guarantees standby kWh for cogeneration

The Pennsylvania Public Utility Commission (PUC) issued a tentative decision that a 1985 Federal Energy Regulatory Commission order does not affect state laws or regulations on the obligations of jurisdictional utilities to their customers. The case concerns the Philadelphia utility's obligation to provide backup power to a cogenerator (Alcon). FERC's ruling would have allowed a utility to withhold backup power, but the PUC stated that the utility must meet its obligations. The cogeneration industry considers the FERC ruling a major deterrent to cogeneration projects. Action on the reconsideration could come by April.
