1985 in cogeneration and small power

The Alcon decision by the Federal Energy Regulatory Commission (FERC) was the most noteworthy development affecting cogeneration during 1985. FERC ruled that the customer of a cogenerator has no right to receive supplementary, backup, or maintenance power under the Public Utility Regulatory Policies Act (PURPA) even though such service is needed for most cogeneration projects because of the high costs of providing independent backup. Utilities opposed to cogeneration used the Alcon decision to deny backup power to cogeneration facilities financed through third parties. FERC has since agreed to a rehearing, and a petition in Pennsylvania calls for a state law to meet the need. An overview of state actions covers wheeling regulations, requirements for qualifying status, the relationship of cogenerators and power pools, state implementation, and new facility filings.
