FERC limits right of third-party-financed projects to backup power

The FERC, in an order issued in the case of Alcon (Puerto Rico) Inc. (QF84-147), ruled that third-party-financed cogeneration facilities do not have the right to supplementary, backup, and maintenance power under PURPA. The decision is an extension of the Commission's established policy of leaving the regulation of retail sales by cogenerators to the discretion of the states and nonregulated utilities.
