ALCON III: right to backup power under ALCON decision restricted

The Federal Energy Regulatory Commission (FERC) has reversed its earlier position that a customer of a cogenerator had no right to backup power under the Public Utility Regulatory Policies Act (PURPA). The reversal appeared to vindidate those who saw third-party financing as irrelevant. A March 26 order, however, limits this interpretation so that cases involving retail sales remain unresolved at the state level.
