FERC reverses Alcon decision

The Federal Energy Regulatory Commission (FERC) has reversed the Alcon decision because the original decision was not consistent with the Public Utility Regulatory Policies Act because financing methods could disqualify entities using a power from a qualifying facilities from receiving backup power from the utility. The Alcon decision was only a problem if the state commission opposed cogeneration. The reversal of Alcon has not had much impact because state commissions respond primarily to the need for added capacity, but it does indicate FERC's bias in favor of cogeneration.
