Pennsylvania overrides Alcon - rules qualified facility customers entitled to backup under state law

The Pennsylvania Public Utility Commission made a landmark decision when it ruled that customers as well as cogenerators and small power producers are entitled to backup and maintenance service from electric utilities as a matter of state law. Since over half of all cogeneration projects have third-party financing, the end-user becomes the customer. Federal law does not grant customers of cogenerators this right. The author discusses the impact of the Alcon decision, which states that state protection is necessary in the absence of federal protection, as it relates to the Public Utility Regulatory Policies Act.
