The Supreme Court has reaffirmed several accepted principles of judicial review of Federal Energy Regulatory Commission (FERC) orders, including (1) whether a party has satisfied the jurisdictional prerequisites to judicial review, (2) when rehearing and judicial review should be sought, (3) whether a person is a party to a Commission proceeding, (4) how to determine which court of appeals has jurisdiction, and (5) whether suspension orders are subject to judicial review. This report integrates past cases and recent decisions, and advises practitioners before FERC and the courts of appeals of the implications of the principles set out in the cases. It focuses on review of the Federal Power Act, Natural Gas Act, and Natural Gas Policy Act of 1978 because most of the cases address these matters.
