EPA maintains RCRA rules

Under a federal court deadline, the Environmental Protection Agency has reissued without change two hazardous waste regulations under the Resource Conservation and Recovery Act (RCRA). Replacement rules are to be proposed and released for a comment period by April 28. EPA says final regulations-expected to be less stringent than the original rules-will be issued by April 28, 1993, when the {open_quotes}mixture{close_quotes} and {open_quotes}derived-from{close_quotes} rules will expire. {open_quotes}We`re disappointed that the agency failed to provide any interim relief,{close_quotes} says Aaron Goldberg, an attorney at Beveridge and Diamond (Washington), which represented industrial groups challenging the rules. Chemical Manufacturers Association vice president/regulatory affairs Mort Mullins expects the new rules to use risk-based concentration limits-which EPA says it has been planning- or a characteristic-based system, which would regulate reactive, flammable, and corrosive wastes.
