RCRA ruling leaves industry guessing

Last month`s ruling by a Washington, DC federal appeals court overturning key elements of the hazardous waste definitions under the Resource Conservation and Recovery Act (RCRA) has the affected industries assessing the potential impact, and wondering what EPA`s response is likely to be. The court overturned the {open_quotes}mixture{close_quotes} rule, which defines as hazardous all waste mixtures that contain any amount of hazardous waste, and the {open_quotes}derived-from{close_quotes} rule, under which residue from the treatment of hazardous waste is itself regulated as hazardous.
