EPA`s revision or replacement of the mixture and derived-from rules was to have been issued by October 1994. However, the agency is experiencing significant difficulty in achieving consensus among the major stakeholders in this rulemaking - also known as the RCRA hazardous waste identification rule (HWIR). Since HWIR will contain provisions letting some wastes {open_quotes}out{close_quotes} that are currently regulated as hazardous under the derived-from rule, several industry trade organizations brought legal action against EPA when the October 1, 1994 deadline passed. To avoid protracted litigation, the agency entered into a consent decree on November 14, 1994 with the Environmental Technology Council (ETC-previously known as the Hazardous Waste Treatment Council) and the Edison Electric Institute (EEI) in US District Court for the District of Columbia.
