Credible evidence heads for courts
Industry coalitions have begun preparing legal challenges to new EPA rules on what data industry must report to demonstrate compliance with Clean Air Act (CAA) emissions standards and what data can be used by regulators and citizens` groups to establish that a violation has occurred. The first confrontation will be over a rule issued last week that allows use of any {open_quotes}credible evidence{close_quotes} of unlawful emissions to prove CAA violations. EPA and environmental groups call the credible evidence rule a {open_quotes}housekeeping{close_quotes} step to clarify existing legal standards. Natural Resources Defense Council (NRDC) attorney James Pew says the rule is supported by the 1990 CAA Amendments. He says the 1990 amendments reversed a law that was the basis of a 1984 federal court decision to dismiss an EPA enforcement action against a steel mill because the violation was not proved using EPA`s test method.
