The Federal Energy Regulatory Commission (FERC) issued a Notice of Proposed Rulemaking (NOPR) this spring that crashed like a wave over the bow of the electric utility industry. Nicknamed the mega-NOPR, this document is designed to concurrently deal with two topics: non-discriminatory access to the wholesale transmission system by public utilities; and recovery of stranded costs by public and transmitting utilities. If the FERC pushes hard -as it did to issue the NOPR- a final order could be in place as early as late 1995 or early 1996. The regulations promise to have a dramatic effect on the U.S. electricity market, changing the way utilities and independent power producers (IPP) do business in the future.
