Witnesses at a hearing to examine compliance with the 1982 Nuclear Waste Policy Act in light of the DOE's decision that DOE is not bound to the requirement of recommending three repository sites. Critics from the western states, while sympathetic, argue that a political compromise in regard to recommending a second repository made passage of the Act possible since the first repository will be sited in the West. At issue was the integrity and credibility of the DOE. Support for the decision came from the American Nuclear Energy Council on behalf of the nuclear utilities on grounds that it does not represent the termination of the program, but will allow DOE to concentrate on selecting the final site from the three alternatives selected in Phase I. The 10 witnesses also spoke for several states, the Nez Perce Tribe, and DOE.
