Representatives of the coal industry, environmental groups, and the Department of the Interior (DOI) were the principal witnesses at a hearing on S. 1634, which amends the 1920 Mineral Lands Leasing Act and the 1976 Coal Leasing Act Amendments by removing the requirement that lease holders relinquish non-producing leases before bidding on a new lease. Support for the amendment by the DOI emphasized that the provisions will enable the coal industry to remain productive and competitive by eliminating requirements for contiguous holdings and simplifying lease requirements. Witnesses stressed the need to repeal section 3 of the Act, which they see as a threat to future energy production. Opposition to the repeal of section 3 and the contiguity requirement came from environmentalists, who cited the large number of non-producing leases held by major companies and the opportunity for abuse if the due diligence concept is abandoned. An appendix with responses to additional questions follows the test of S. 1634 and the testimony of 15 witnesses.
