The hearing was called to consider Senate bill S.1120 which would amend provisions of the Mineral Leasing Act of 1920 to improve the administration of the Federal Coal Leasing Program. Under existing law a lessee holder must produce commercial quantities of coal within 10 years or lose the lease. The new bill would retain this 10-year diligent development, but would allow extension of the deadline by payment of royalties in advance for a 5-yr extension or by royalty payments and a substantial investment in the lease for up to 10 years extension. Another provision of the new bill would exempt lessees who hold mined out coal leases for reclamation purposes from the prohibition on obtaining new leases. The text of the bill is presented. Testimony was heard from 9 witnesses, representing the DOI Land and Minerals Management, electric power industry, coal industry, Sierra Club, and states of Colorado and Montana. Additional material was submitted by the National Rural Electric Cooperative Association and the Western Fuels Association.
