Title: Economic variances from BPT standards of the Water Pollution Control Act: EPA v. National Crushed Stone Ass'n

The Supreme Court held in EPA (Environmental Protection Agency) v. National Crushed Stone Association that industrial water polluters are not entitled to an economic variance from the Federal Water Pollution Control Act's ''best practicable control technology currently available'' (BPT) effluent limitation. Congress has exhibited a certain restlessness with the policy of deferring to agency expertise and decision making, while both Congress and the Reagan administration have increasingly questioned the basic attitudes and premises of the Clean Water and Clean Air Acts. The Court will follow its traditional course of deferring to agency decisions in statutorily mandated promulgations, Congress may use legislative means to strip the agencies of much of their decision making power. 44 references.
