Variances in effluent guidelines and standards. a withdrawal of interpretations

A withdrawal of interpretations of the ''variance clause'' for best practicable technology (BPT) national effluent guidelines regulations of the Clean Water Act is issued by the U.S. Environmental Protection Agency. According to these interpretations, plant-specific compliance costs were not among the factors which could be considered under the BPT variance clause. However, these interpretations have been superseded by subsequent court decisions. In order to clear up any lingering confusions the EPA withdraws these interpretations. While the EPA allows compliance costs to be considered under the BPT variance clause, it should be noted that the section of the Clean Water Act which allows waivers based upon plant-specific economic capability or ''affordability'', applies only to best available technology limitations.
