H.R. 4632 and H.R. 4370 provide an opportunity for the Secretary of the Interior to grant rights-of-way across public lands and certain non-federal lands for the construction and operation of coal company pipelines. Both bills address the issue of state water rights. The provisions of the Federal Water Pollution Control Act address potential water pollution problems. The bills require the Secretary to consider the economic impact of Federal authorization of these pipelines. Competitive factors should lower the costs of coal transportation. The National Environmental Policy Act of 1969 provides the Secretary with broad independent authority to address and control all environmental issues raised as a result of these projects.
