The NOPR's (Notice of Proposed Rulemakings) effect on financing

In mid-1988, the Federal Energy Regulatory Commission (FERC) issued three Notice of Proposed Rulemaking (NOPRs) for changes to the Public Utility Regulatory Policies Act (PURPA). The first, RM898-6: Administrative Determination of Full Avoided Costs, is also called the ADFAC NOPR. The second, RM88-5, proposes regulations governing competitive bidding programs. The third, RM88-4, proposes rules for establishing Independent Power Production facilities (IPPs) which are not subject to fuel and efficiency restrictions under PURPA. A fourth NOPR, RM88-17, addresses various issues concerning PURPA including the allowed percentage of electric utility ownership. The FERC's proposed rule changes could have a significant negative impact on the cost and availability of capital for independent power projects. The rules make the assignment of financial risk more difficult and would undoubtedly leave less capitalized firms out of the market.
