Federal/state tension heats up

In mid-March of this year, the Federal Energy Regulatory Commission issued their three Notices of Proposed Rulemakings (NOPRs) concerning non-utility power generation. State public utility commissioners expected the first two (covering bidding programs and administrative avoided costs), but the third caught many by surprise, confusing some and aggravating most. That proposed rule would create a new classification of generators - independent power producers (IPP). While the industry's eyes are focused on the FERC's three notices of proposed rulemakings, state utility commissions continue to move on their own - implementing or carrying on with policies that best fit their state's power requirements. Commissioners with a number of states feel that the FERC is usurping their authority while sidestepping the transmission access issue. Policies of the following states are highlighted: Connecticut, New York, Michigan, Massachusetts, Illinois, Pennsylvania, Virginia, and Maine.
