Utility, users fight over $1B from Texaco

Texaco Inc. is paying Louisiana Power and Light over $1 billion for reducing its natural gas demand, and industrial users want the money returned to them as a refund rather than reinvested in a nuclear plant under construction. A shortage of natural gas prompted Texaco to offer financial incentives to large users to cut their consumption. Users claim they are entitled to the refunds because they paid 60% of the supplementary cost when Texaco could not meet its contract obligations. The utility hopes to avoid a large rate increase to reduce construction debts for the nearly completed Waterford 3 nuclear plant. (DCK)
