Texas users fight PUC refunds policy

Industrial energy users in Texas are fighting a relatively new policy adopted by the Public Utility Commission that could prevent some from recovering millions of dollars in electricity rate refunds while boosting payments to others. The issue is whether utilities should pay refunds in a check to each user on the basis of past use at the time of the overcharge (retrospectively), or whether they should pay on the basis of future use (prospectively) in rate adjustments. Some customers are fighting the prospective refund method on principle, others because they have curtailed energy purchases. The Commission favors the prospective method because it is simpler.
