Utility discount rates may violate laws, public policy, PUCs warned

Utility discount rates to defer cogeneration may violate antitrust laws, traditional regulatory principles, and the Public Utility Regulatory Policies (PURPA) Act, according to the Cogeneration Coalition of America. The coalition argues that the rates are discriminatory and seek a monopoly market. Six guidelines for utility commissions recommend policies and prices which benefit all customers, a lower priority to economic development of the utility, and better cost allocation procedures by utilities.
