CCA Inc. challenges state commission approval of anti-cogen discounts and contract provisions

The Cogeneration Coalition of America, Inc. has challenged proposals in several states for anti-cogeneration rate discounts and contract provisions in a petition to the Federal Energy Regulatory Commission. The rates and contract practices are anti-competitive, according to the coalition, and violate federal legal requirements. Proposals in several states could, if approved by state commissions, reduce the potential market for cogeneration by as much as 70%. The Coalition calls upon FERC to investigate state implementation of the Public Utility Regulatory Policies Act.
