Texas passes sanctity of contract legislation

The problems associated with obtaining a financeable power sales agreement make it difficult to develop cogeneration in Texas. Contract phrases which permit utility commissions to change contract rates make financing difficult. The new Texas law (SB 141) is important because of the unmet need for new capacity and the constraints developers have complained about. The law could open up a new gold rush, but the major issue will be whether the state commission will allow utilities to reject independent power options in favor of building their own facilities.
