Clean Water Act permitting: the NPDES program at fifteen

Despite 15 years of implementing the National Pollutant Discharge Elimination System (NPDES), new issues continue to arise and old ones remain unresolved. The author discusses three major aspects of the current NPDES permitting program: its scope, substantive permit application requirements, and permit terms and conditions. A court order now requires the Environmental Protection Agency and the Corps of Engineers to propose a definition of fill as the result of litigation over a permit application. Other areas of controversy are the increasing use of laboratory toxicity tests in the regulatory process.
