FERC turns down first bid for enforcement under PURPA

The Federal Energy Regulatory Commission (FERC) decided that it will in almost all cases refer cogenerators and small power producers aggrieved by utility failure to comply with the Public Utility Regulatory Policies Act (PURPA) to the states; and in particular, will refer nonregulated utilities to the local courts. The ruling is the result of a petition against the Puerto Rico Electric Power Authority (PREPA), which has since begun to recognize the qualifying status of cogenerators and small power producers. PREPA has moved the battle by proposing to increase its rate for backup service to twice the demand charge for general service.
