First enforcement action under PURPA brought against Puerto Rico Electric Power Authority

The Federal Energy Regulatory Commission (FERC) has been asked to take enforcement action against the Puerto Rico Electric Power Authority (PREPA), which has intervened against all cogeneration applications under the Public Utilities Regulatory Policies Act. Since the complaint, the utility has allowed an application for a windmill to go unchallenged because wind power is not seen as a threat. FERC's policy is to leave enforcement to the states, but PREPA will lose in the long run if it continues to discourage cogeneration projects in Puerto Rico.
