NY approves cogeneration rate; nationwide precedent seen

A landmark decision by the New York Supreme Court preserved the 6-cent/kWh floor for utility power purchases from cogenerators. Resolution of the suit by Consolidated Edison Co. will encourage the financing of cogeneration projects by removing economic uncertainties. Nationally, this is the first decision confirming a buy-back rate that exceeds utility avoided costs, and could establish a precedent for other states.
