High Court decision removes final cogeneration obstacles

Attractive rates for excess cogenerated power sold to utilities and insured connections with utilities now have Supreme Court approval. This removes a major uncertainty for 200 to 300 cogeneration projects that were stalled because a lower court had jeopardized the Federal Energy Regulatory Commission (FERC) rulings. Three utilities challenged the FERC rulings on grounds that they were biased toward cogenerators, but the Court gave precedence to national policies designed to encourage cogeneration. The strong endorsement of the ruling for rates based on full avoided costs will make it easier to secure financing for the projects. (DCK)
