FERC's avoided cost, interconnection rules overturned by Appeals Court

The US Court of Appeals struck down the rule requiring utilities to pay cogenerators and small power producers the full avoided costs and the rule allowing cogenerators to intercionnect with utilities without first meeting Federal Power Act requirements. The decisions to vacate these Public Utility Regulatory Policies Act rules will slow the move to alternative energy production, but there will be a hearing and possible Supreme Court appeal on the issues before the decision takes effect. The lack of balance in benefits to cogenerators and utility customers is the basis for the decision. (DCK)
