PURPA moves to Supreme Court: small power firms threatened

The Supreme Court will hear arguments on the constitutionality of Section 210 of the Public Utility Regulatory Policies Act (PURPA) which requires electric utilities to provide power and to purchase power from cogenerators and small power producers at non-discriminatory rates and exempts small companies from certain state and federal regulations. A Mississippi district court ruled against its constitutionality, but the government appealed partly to resolve the states rights aspect of the case. PURPA is considered vital for private, small producers to penetrate the market and provide a needed source of power. The issue is not so much the interchange of electric power as the rate-setting aspect. (DCK)
