Proposed sea-change in natural gas regulation

A legal review of the Federal Energy Regulatory Commission (FERC) Notice of Proposed Rulemaking, designed to make the natural gas industry more competitive, focuses on the legality of three key components: (1) the block billing mechanism, (2) the just and reasonable presumption for Block 2 gas sold by pipelines that provide non-discriminatory transportation, and (3) the provision for expedited certification. The author concludes that the proposals have the potential to move the industry in the direction of effective competition despite their defects. The block billing proposal segregates gas as to which rents are to be captured from all other gas, thus laying the groundwork for relaxed regulation of the latter. If FERC assures adequate access to the wellhead market, relaxed price regulation is justified. Expedited certification can enable FERC to cease operating as an incumbent protection agency. 1 table.
