DOE issues interim coal switch rules

DOE, in an interim ruling, has determined that only excessively high conversion costs will exempt industrial users from burning coal in existing units. The costs of conversion must exceed present fuel costs by 30%. August 15 is the deadline for comment on the ruling and there is a possibility the figure will be lowered to 10% since the Economic Regulatory Administration (ERA) has admitted it may have erred in its cost calculations. Rules for small boilers and aggregations of units in close proximity have been relaxed. The Fuel Use Act also encourages co-generation and alternate fuels, but does not include steam, electricity, coal-oil slurries, or compressed air. Environmental exemptions, fees for filing exemption petitions, and capital availability rules are also eased, but the possibility of competitive disadvantage does not qualify for exemption.
