Supreme Court says yes to bubble, avoids tall stacks

This paper discusses the Supreme Court's decision to reinstate a 1981 ''bubble'' policy that permits industrial plants to expand or upgrade facilities without an environmental review, as long as the increased emissions of air pollution are offset by an equivalent decrease elsewhere. Under the court's ruling, EPA must rewrite stackheight rules within six months. In addition, 141 utility stacks will now be subject to increased emission controls, since they were built or increased in height during the last three years under the now-defunct policy.
