Legislative proposals and recent or pending judicial decisions reflect intensifying competition for the nation's hydroelectric resources. The activity focuses on the preference issue, specifically on relicensing. Federal Energy Regulatory Commission interpretation of existing law in 1980 was that state and municipal utilities would be preferred at the time of relicensing even an existing, non-government operator of the project, but FERC reversed itself in 1983. The Shelby Bill (H.R. 4402) and the Ottinger Bill (H.R. 5299) address the compensation standard. Other proposed legislation calls for anti-trust review as a condition for relicensing, favor the existing licensee, and a proposal for auctioning of power from Hoover Dam to the highest bidder. Private entities want to hold onto their relatively small holdings, while preference entities want to gain an even greater share of hydro resources.
