Legal aspects of subsidence due to well pumping

Subsidence of land due to groundwater withdrawal is a relatively recent phenomenon. Early cases based on English common law held that an individual who pumped groundwater was not liable for damage to a neighbor's property. Recent cases and litigation indicate a trend toward holding groundwater pumpers liable for adverse effects of their withdrawals. The growing recognition that water is a limited resource will, in time, bring about mandatory groundwater management legislation which will place the subsidence control burden on local water agencies.
