Sinking fortunes: Texas remedies for victims of land subsidence

The case of Friendswood Development Co. vs. Smith-Southwest industries is reported. Plaintiff Smith-Southwest Industries and owners of neighboring residential and commercial property in Harris and Galveston counties on the Texas coast maintained that groundwater withdrawals by the Friendswood Development Co. had irreparably damaged their property. The court held that Friendswood could not be held liable for the property damage already done in Harris and Galvestion counties. The company would, however, be held liable for any future damage to property as a result of groundwater withdrawals. (74 references)
