Role of coastal states in Outer Continental Shelf oil and gas leasing: a litigation perspective

Congress has granted states significant influence over Outer Contintal Shelf (OCS) leasing decisions, but the Department of Interior exercises wide discretion in making OCS leasing decisions. California is litigating two lease sales, Sales 53 and 68, whose resolutions will significantly affect the degree of cooperation between coastal states and the federal government. Historical information on both sales, state and federal positions, judicial decisions, and subsequent evasive actions by Interior are reviewed.
