Application of the Coastal Zone Management Act to Outer Continental Shelf lease sales
This article examines the application of the federal consistency provision in Coastal Zone Management Act (CZMA) to Outer Continental Shelf (OCS) lease sales. Section I describes CZMA, Outer Continental Shelf Lands Act (OCSLA), and the interaction between them. Section II discusses the relevant portions of the two statutes, namely the CZMA consistency provision and the mechanism for state and local involvement in the decisionmaking process in OCSLA. Section III analyzes the policy considerations behind the application of the consistency determination. The section concludes tht the state is the most appropriate decisionmaker, and, therefore, that federal OCS lease sales must be consistent with the state's coastal zone management plan under CZMA.
