Hydroelectric relicensing: a disputed call for congressional action

Hydroelectric power is currently at the center of a controversy between investor-owned utilities and their public counterparts because few, if any, of the problems that beset fossil- and nuclear-fueled electricity production are associated with hydroelectric generation, together with the vague nature of current law and conflicting regulatory interpretation. At issue is municipal preference in hydroelectric relicensing proceedings and whether or not this preference exists under the Federal Power Act. The author traces the roots of the dispute from the Federal Power Act to the current range of bills in Congress that seek to clarify regulations. The prospects for legislative clarification are uncertain given the diametric opposition of the competing interests, although there is a distinct possibility that this congressional session will remove municipal preference.
