Court says munis have relicensing preference

A federal appeals court panel affirming municipal preference for hydroelectric plants which are up for renewal of their licenses reversed a Federal Energy Regulatory Commission (FERC) decision, and may lead to a Supreme Court appeal. Public power agencies and investor-owned utilities disagree over whether the municipal preference of the Federal Power Act of 1920 applies to new projects only. The case in question involves the Merwin plant in Washington which involved an earlier reversal of FERC's position and litigation. The Edison Electric Institute projects a loss to consumers of hydro projects worth billions of dollars if relicensing leads to a shift from private to municipal ownership.
