FERC Order 636 and how it affects different segments of the natural gas industry: Representing the regulators

FERC Order 636-B has been finished. The Order clarifies some points in FERC Orders 636 and 636-A, the so-called [open quotes]Restructuring Rule,[close quotes] which completely changes the way the gas industry functions in this country. The rule making process is now ended. That means that the framework within which everyone can work has now been finished. The Commission can go forward with implementing the rule through restructuring cases. And the gas industry can decide how it wants to move forward. There will be court reviews. But it is hoped that the Courts will back the Commission up, especially on the basics. Order 636 sets out a sensible policy that will be good for the whole country. The Commission's major policy initiatives have had general support from appointees from both political parties. In addition, the new energy law directly and clearly ratified the direction on electric power with broad support from across the political spectrum. Its relative silence on gas issues represents a strong signal that the basic approach on the gas side is a sound one.
