Transporters can be held liable for remediation of a Superfund hazardous waste disposal site only if they delivered hazardous wastes to the site and participated in selecting the site for disposal. This opinion was confirmed in a recommendation filed July 19, 1994 by the US District Court for the Eastern District of Pennsylvania in a third-party contribution suit over the Moyer Landfill Superfund site (United States et al. v. Aluminum Company of America et al. and Superior Tube Company v. Air Products and Chemicals, Inc. et al., Dockett Number 89-7421). The courts recommendation to dismiss the third party claim confirms similar rulings about transporter liability under CERCLA.
