The Superfund liability scheme: A goal-based approach to reauthorization

The paramount goal of Superfund is prompt cleanup of hazardous waste sites. An additional goal of Superfund is to efficiently and equitably allocate response costs among responsible parties. A third goal is to deter current and future releases of hazardous substances. This article argues that the first and third goals of Superfund should take priority over the second, and retroactive liability for pollution caused prior to the passage of CERCLA should be eliminated.
