Hydropower compliance program at the Federal Energy Regulatory Commission

In March 1988, the U.S. General Accounting Office (GAO) issued a report on the Federal Energy Regulatory Commission`s (FERC/Commission) enforcement of the terms and conditions of its licenses and exemptions. The GAO found that because of ineffective controls, FERC`s monitoring of compliance with items required by licenses and exemptions did not always result in timely and consistent actions. GAO further stated that, because of inaccurate data, FERC`s tracking system was of limited use as a tool to carry out and oversee required monitoring. Six years later, in May 1994, after full implementation of the Electric Consumers Protection Act (ECPA), GAO issued a follow-up report stating that FERC`s monitoring procedures and practices ensure that non-federal hydroelectric projects are operating in compliance with their requirements. FERC`s procedures for investigating allegations of non-compliance are adequate and generally followed, according to GAO, and FERC`s monitoring and enforcement efforts to ensure structural soundness, public safety and environmental protection are showing positive results. GAO saw no need to recommend improvements in FERC`s compliance efforts.
