N.J. sets example for cleanup funding

As states re-examine their environmental regulations, many are exploring mechanisms to encourage private parties and local governments to clean up certain polluted sites voluntarily. Besides addressing immediate environmental and public health concerns, the impetus for such actions is potential economic gain. Programs that help free formerly dormant properties from use restrictions may invite new investment and spark revitalization of key areas in local communities. Some states have begun to address this issue by redefining and tailoring cleanup requirements to each site`s geographic location and probable future use. Standards assigned to non-residential sites typically are less strict than those applied to residential or recreational areas. In addition, prior ``no sale`` conditions on properties may be relaxed in some instances, with the stipulation that the buyer is aware that contamination exists and a remedial plan has been approved by the appropriate agency. Some states offer public and private interests direct assistance in addressing potentially contaminated properties. For example, New Jersey provides municipalities, companies and individuals with grants and loans for site assessment and remediation. Although this practice is not widespread, it is an important development from a national perspective, as it provides funding mechanisms that were unavailable in the past. Given New Jersey`s precedent-setting record in developing progressive environmental regulations and guidelines, the state`s example in funding voluntary cleanups ultimately could open new opportunities nationwide.
