When FERC and states collide

The requirement that hydroelectric projects secure a state water quality permit pursuant to Section 401 of the federal Clean Water Act is long-standing. Equal in age is the recognition of the conflict which this requirement creates. In one example, a Maine company spent more than 30 months in the process. After several court cases in which a favorable appeal was overturned, the company chose not to pursue further legal action. This is the kind of challenge hydropower project owners are facing under current conditions.
