Law on U. S. coal leasing gives the helm to Andrus

The Federal Coal Leasing Amendments Act of 1975 amended the Mineral Lands Leasing Act of 1920. Further, the Federal Land Policy and Management Act of 1976, which passed on October 21, amended the 1975 law. Under the 1975 Amendments Act, each coal lease shall contain provisions requiring compliance with the Federal Water Pollution Control Act and the Clean Air Act. Secretary of the Interior, Cecil D. Andrus, is largely in control of coal leases under this act to divide lands into coal-leasing tracts and to award leases by competitive bidding. Effects of the laws on the federally owned and controlled coal reserves in the West are described, but the new law also gives the federal government control over privately owned land within a logical mining unit (an area of land in which the coal reserves can be developed in an efficient, economical, and orderly manner as a unit with due regard to conservation of coal reserves and other resources). The governors of states and the public will have some voice in coal leasing, but hearings must be held by the Interior Secretary prior to leasing. (MCW)
