States back PURPA ruling by US Supreme Court

The Idaho Supreme Court upheld a Public Utility Regulatory Policies Act (PURPA) requirement that investor-owned utilities must buy power from small producers at the avoided cost. Dissenting judges contended that the requirement allows federal usurpation of state regulatory power in violation of the Tenth Amendment. The majority saw it as a way to confer authority to state commission and encourage power generation from nonconventional sources. A similar case in Florida remanded required the state to pass enabling legislation.
